Bas\u0131n hukuku alan\u0131nda s\u0131k s\u0131k kanun de\u011fi\u015fikliklerinin yap\u0131ld\u0131\u011f\u0131 T\u00fcrkiyede, 2004 y\u0131l\u0131nda 5680 say\u0131l\u0131 eski Bas\u0131n Kanunu kald\u0131r\u0131lm\u0131\u015f, 5187 say\u0131l\u0131 yeni Bas\u0131n Kanunu y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir.<\/p>\n<p>5187 say\u0131l\u0131 Kanunla, bas\u0131n yoluyla i\u015flenen su\u00e7lara ili\u015fkin ceza sorumlulu\u011fu yeniden d\u00fczenlenmi\u015ftir. Ayr\u0131ca ceza hukuku reformu kapsam\u0131nda 765 say\u0131l\u0131 eski TCK kald\u0131r\u0131larak 5237 say\u0131l\u0131 yeni TCK, 1 Haziran 2005 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir. Yeni TCKn\u0131n genel h\u00fck\u00fcmler b\u00f6l\u00fcm\u00fcnde su\u00e7 ve ceza teorisi a\u00e7\u0131s\u0131ndan eski yasaya g\u00f6re \u00e7ok \u00f6nemli yenilikler getirilmi\u015ftir. TCKn\u0131n 5. maddesinde eski kanundan farkl\u0131 olarak bu kanunun genel h\u00fck\u00fcmleri, \u00f6zel ceza kanunlar\u0131 ve ceza i\u00e7eren su\u00e7lar hakk\u0131nda da uygulan\u0131r h\u00fckm\u00fcne yer verilmi\u015ftir. Bu nedenle bas\u0131n yoluyla i\u015flenen su\u00e7larda sorumluluk konusunun TCKn\u0131n genel h\u00fck\u00fcmleri \u00e7er\u00e7evesinde de\u011ferlendirilmesi \u00f6nem ta\u015f\u0131maktad\u0131r.<\/p>\n<p>Gazi \u00dcniversitesi Sosyal Bilimler Enstit\u00fcs\u00fc Kamu Hukuku Ana Bilim Dal\u0131nda y\u00fcksek lisans tezi olarak haz\u0131rlanan bu \u00e7al\u0131\u015fmada, TCK n\u0131n genel h\u00fck\u00fcmlerinin bas\u0131n yoluyla i\u015flenen su\u00e7lara ili\u015fkin ceza sorumlulu\u011funu nas\u0131l etkileyece\u011fi incelenmi\u015ftir. Bas\u0131n Kanununun 11. maddesine g\u00f6re s\u00fcreli ve s\u00fcresiz yay\u0131nlarda eser sahibinin belli olmamas\u0131 ya da kanunda belirtilen di\u011fer hallerde, sorumlu m\u00fcd\u00fcr, yay\u0131n y\u00f6netmeni, edit\u00f6r, bas\u0131n dan\u0131\u015fman\u0131, yay\u0131mc\u0131 ve bas\u0131mc\u0131 gibi ki\u015filer de bas\u0131n yoluyla i\u015flenen su\u00e7lardan sorumlu tutulmaktad\u0131r.
